Challenges to the Breathalyzer® and field sobriety tests
The Breathalyzer is a controversial machine that is supposed to measure your blood alcohol content—or BAC. In Indiana, you are presumed to be legally intoxicated if you register a BAC of .08 percent or higher. A BAC of .15 percent or higher subjects you to enhanced penalties. To fight the presumption of intoxication, we aggressively challenge the Breathalyzer — including the technician’s training, the machine’s calibration and the accuracy of the results.
The field sobriety test includes a series of activities designed to evaluate motor skills affected by alcohol or drug use. There are many valid reasons you may fail these tests.
